Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Tamub ("Tamub," "we," "us," or "our") governing your access to and use of our website, mobile application, and all related features — including the social feed, recipe sharing platform, marketplace, and food delivery service (collectively, the "Service"). By creating an account or using the Service in any capacity, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must immediately discontinue use of the Service.

1. Eligibility & Account Registration

To use the Service, you must be at least 13 years of age. Users between the ages of 13 and 17 must have verifiable parental or legal guardian consent prior to creating an account. By registering, you represent that you meet these age requirements and that all information you provide is accurate, current, and complete.

You are solely responsible for:

  • Maintaining the confidentiality and security of your account credentials
  • All activity that occurs under your account, whether or not authorized by you
  • Promptly notifying us at support@tamub.com if you suspect unauthorized access to your account

You may not create multiple accounts for the purpose of circumventing suspensions, evading restrictions, or manipulating platform features such as ratings or reviews. Tamub reserves the right to suspend or permanently terminate accounts found in violation of these Terms, at our sole discretion and without prior notice where circumstances warrant.

2. Know Your Customer (KYC) Verification

Certain features of the Service — including selling in the Marketplace, listing meals as a restaurant, and accessing elevated account privileges — require identity verification ("KYC"). You agree to provide accurate, authentic, and current identification documents when requested. Submitting false, forged, or misleading KYC documentation is a material violation of these Terms and may result in permanent account termination and referral to relevant authorities.

Tamub reserves the right to decline KYC approval without obligation to provide a specific reason. KYC status may be revoked if we determine that previously submitted documentation was inaccurate or that your conduct no longer meets our standards.

3. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:

  • Use the Service in any manner that violates applicable local, national, or international law or regulation
  • Impersonate any person or entity, or falsely represent your affiliation with any person or entity
  • Harass, threaten, intimidate, defame, or harm any other user
  • Attempt to gain unauthorized access to any part of the Service, other users' accounts, or Tamub's systems
  • Use automated tools, bots, scrapers, or scripts to interact with the Service without our prior written consent
  • Reverse engineer, decompile, or attempt to extract the source code of any part of the Service
  • Upload or transmit viruses, malware, or any other malicious or disruptive code
  • Engage in any conduct that could damage, disable, overburden, or impair the Service's functionality
  • Use the Service to solicit users to transact outside of the platform in a manner that circumvents Tamub's processes

4. Social Content & Story Guidelines

Tamub is a community platform and the quality, safety, and respectfulness of content posted by users is fundamental to that community. By posting any content — including stories, posts, comments, images, or other media — you agree to the following standards:

4.1 Permitted Content

  • Original or properly attributed content related to food, recipes, lifestyle, culture, and community experiences
  • Honest reviews and opinions expressed respectfully and in good faith
  • Creative or personal stories that are authentic and do not violate the restrictions below

4.2 Prohibited Content

You may not post content that:

  • Is sexually explicit, obscene, pornographic, or intended to be sexually suggestive
  • Promotes, glorifies, or facilitates violence, self-harm, terrorism, or hate crimes
  • Constitutes hate speech — including content that attacks individuals or groups on the basis of race, ethnicity, religion, gender, sexual orientation, disability, or national origin
  • Harasses, bullies, or targets specific individuals in a harmful manner
  • Contains false or misleading information presented as fact, including fabricated health claims or misinformation about food safety
  • Infringes on any intellectual property rights, including posting copyrighted images, videos, or text without authorization
  • Promotes or facilitates illegal activity, including the sale or use of illegal substances
  • Reveals another person's private or personally identifiable information without their consent ("doxxing")
  • Is spam, repetitive, or artificially boosts engagement through inauthentic means

Tamub reserves the right to remove any content that violates these guidelines or that we determine, in our sole discretion, is harmful to the community — even if not explicitly listed above. Repeated violations may result in account suspension or termination.

5. Recipe Sharing

The recipe section of the Service allows users to share culinary content with the community. In addition to the general content rules in Section 4, the following rules apply specifically to recipe submissions:

  • Recipes must be genuine and accurately described. Do not present others' original recipes as your own without proper credit.
  • Ingredient lists and preparation steps must be complete and accurate to a reasonable degree. Intentionally omitting critical safety-relevant information (e.g., allergens, cooking temperatures for raw proteins) is prohibited.
  • Do not make unsubstantiated health, nutritional, or medicinal claims about recipes. Claims such as "cures diabetes" or "guaranteed weight loss" are prohibited.
  • Recipe content may be processed using AI assistance to enhance presentation. By submitting a recipe, you consent to such processing as described in our Privacy Policy.

6. Marketplace Rules

The Tamub Marketplace allows verified users to list and sell physical goods. Access to the Marketplace requires completed KYC verification. All sellers must comply with the following rules in addition to all other provisions of these Terms.

6.1 Permitted Listings

  • Lawful physical goods in new, used, or handmade condition, accurately described
  • Food-related products that comply with applicable food safety regulations in the seller's jurisdiction

6.2 Prohibited Listings

The following are strictly prohibited from being listed, offered, or sold on the Marketplace:

  • Illegal goods or services of any kind, including controlled substances, prescription medications without proper authorization, counterfeit goods, stolen property, or items that are illegal to sell in the seller's or buyer's jurisdiction
  • Weapons and dangerous materials, including firearms, ammunition, explosives, or any item primarily designed to cause harm
  • Sexually explicit or adult content of any kind, including adult products, pornographic material, or items marketed with sexually suggestive imagery or descriptions
  • Offensive or hateful items, including merchandise that promotes discrimination, hate symbols, or content that degrades individuals or groups based on protected characteristics
  • Counterfeit or infringing goods, including items that falsely bear a brand or trademark, or that reproduce copyrighted material without authorization
  • Misleading or deceptive products, including items falsely described as having capabilities, origins, or qualities they do not possess
  • Unverifiable digital access, such as account credentials, subscription logins, or pirated software

6.3 Honest Listing Standards

Tamub is committed to a trustworthy marketplace. All sellers are required to represent their products honestly and accurately. The following practices are prohibited and may result in immediate listing removal, suspension, or permanent ban:

  • Exaggerated claims: Product descriptions must not overstate the quality, capabilities, ingredients, origin, or results of a product. Superlatives and absolute claims (e.g., "best in the world," "100% guaranteed results") must be substantiable with verifiable evidence.
  • False attributes: Do not misrepresent a product's material composition, size, weight, country of origin, brand, or condition (new, used, refurbished).
  • Misleading imagery: Product photos must accurately represent the item being sold. Stock photos that misrepresent the actual product, or edited images that conceal defects, are prohibited.
  • Artificial urgency or scarcity: Do not falsely claim limited availability, countdown timers, or fabricated demand to pressure buyers into purchasing.
  • Review manipulation: Soliciting, incentivizing, or fabricating reviews is strictly prohibited. Tamub may permanently remove listings and suspend accounts engaged in review fraud.

6.4 Seller Responsibilities

  • Sellers are solely responsible for ensuring their listings comply with all applicable laws and regulations, including consumer protection, food safety, and product liability laws.
  • Sellers must fulfill orders as described and within the communicated timeframe.
  • Sellers must respond to buyer disputes in good faith and in a timely manner.
  • Tamub is not a party to transactions between buyers and sellers and does not guarantee the quality or delivery of any goods or services. However, we reserve the right to intervene in disputes and make final decisions where necessary to protect users.

7. Restaurant Listings & Food Delivery

Restaurants and food vendors may list meals and offer delivery through the Service, subject to KYC verification and compliance with all applicable food safety and licensing regulations.

7.1 Accurate Meal Descriptions

  • Honest descriptions: All meal listings must accurately describe the dish, including key ingredients, portion sizes, and preparation methods. Descriptions must not overstate the quality, taste, freshness, or presentation of the food.
  • Allergen disclosure: Restaurants must clearly disclose the presence of common allergens (including but not limited to nuts, gluten, dairy, shellfish, and eggs) in all applicable listings. Failure to do so may expose the restaurant to legal liability and will result in listing removal.
  • Accurate photography: Meal images must represent the actual dish served. Highly stylized or misleading images that create unrealistic expectations are prohibited.
  • Pricing transparency: All fees, delivery charges, and applicable taxes must be clearly disclosed before the buyer confirms an order.

7.2 Restaurant Obligations

  • Restaurants are solely responsible for food safety, hygiene, and compliance with local health regulations.
  • Restaurants must honor listed prices and fulfill orders within the communicated preparation and delivery timeframe.
  • Restaurants must maintain accurate availability — listing items as available when they are not constitutes a deceptive practice and may result in suspension.
  • Tamub is a platform facilitating the connection between restaurants and customers. We are not responsible for the quality, safety, or delivery of food orders, though we may mediate disputes at our discretion.

8. Payments & Transactions

Certain features of the Service, including marketplace purchases and food delivery orders, require payment. By making a purchase through the Service, you agree to the following:

  • You authorize Tamub or its designated payment processor to charge the payment method you provide for the total amount of your order, including applicable fees and taxes.
  • All sales are final unless a specific refund or return policy is stated by the seller or restaurant, or unless a dispute is upheld in your favor through Tamub's dispute resolution process.
  • You are responsible for all charges incurred under your account, including unauthorized charges resulting from your failure to maintain account security.
  • Fraudulent transactions, chargebacks filed in bad faith, or abuse of refund processes may result in account suspension and recovery of amounts owed.
  • Tamub reserves the right to modify its fee structure at any time, with advance notice provided before changes take effect.

9. Content Ownership & License

You retain full ownership of the original content you submit to the Service, including posts, recipes, product listings, and reviews ("User Content"). By submitting User Content, you grant Tamub a non-exclusive, worldwide, royalty-free, sublicensable license to use, store, reproduce, display, adapt, and distribute your User Content solely for the purposes of operating, improving, and promoting the Service. This license ends when you delete your content or close your account, except to the extent your content has been shared with others who have not deleted it.

You represent and warrant that you have all necessary rights to grant the above license, and that your User Content does not infringe on the rights of any third party.

All Tamub branding, trademarks, software, design, and proprietary content are the exclusive property of Tamub and its licensors. Nothing in these Terms grants you a right to use Tamub's name, logo, or intellectual property without our prior written consent.

10. Enforcement & Content Moderation

Tamub reserves the right, but not the obligation, to monitor, review, and moderate User Content and activity on the Service. We may, at our sole discretion and without prior notice:

  • Remove or restrict content that violates these Terms or our community standards
  • Issue warnings, temporarily suspend, or permanently terminate accounts
  • Cancel or remove listings from the Marketplace or food delivery section
  • Report activity to law enforcement where required or deemed appropriate

Users who believe their content has been removed or account suspended in error may contact us at support@tamub.com to request a review. Tamub's decisions on enforcement matters are final.

11. Disclaimers & Limitation of Liability

The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

To the maximum extent permitted by applicable law, Tamub and its officers, directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, or goodwill — arising out of or in connection with your use of or inability to use the Service, regardless of the theory of liability and even if we have been advised of the possibility of such damages.

Tamub's total liability to you for any claims arising under these Terms shall not exceed the greater of (a) the amount you paid to Tamub in the 90 days preceding the claim, or (b) one hundred dollars (USD $100). Some jurisdictions do not allow the exclusion or limitation of certain damages, so these limitations may not apply to you.

12. Indemnification

You agree to indemnify, defend, and hold harmless Tamub, its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of or access to the Service; (b) your User Content; (c) your violation of these Terms; (d) your violation of any applicable law or third-party right; or (e) any transaction you conduct through the Marketplace or food delivery service.

13. Modifications to the Service & Terms

Tamub reserves the right to modify, suspend, or discontinue any part of the Service at any time without liability. We may also revise these Terms from time to time. When we make material changes, we will update the "Last Updated" date at the top of this page and notify you via in-app notification or email. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service.

14. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Tamub is registered, without regard to its conflict of law provisions. Any disputes arising under these Terms that cannot be resolved informally shall be subject to the exclusive jurisdiction of the courts in that jurisdiction, unless otherwise required by applicable consumer protection law in your country of residence.

Before initiating formal legal proceedings, you agree to contact us at support@tamub.com and provide a written description of the dispute. We will make reasonable efforts to resolve the matter informally within 30 days.
